  • This “loophole” wouldn’t work. There are plenty of people in the line of succession that are ineligible to be President either due to being too young or being foreign-born. First, if it gets to the point where one of them would even become President, we have much bigger problems to worry about. Second, those people that would be ineligible would simply be skipped over for the next person in line who’s actually eligible.

Sure, they could use the same backwards logic and hand-waving of Constitutional amendments that they’ve been using all along, but at that point they might as well just make an exception for the 22nd amendment and call it a day. If they’re just planning to hand-wave away the rules anyway, why go through all those extra steps when just saying that the 22nd amendment is unenforceable would be quicker, easier, and accomplish the same thing?

  • Without a constitutional amendment, it’s not going to happen.

Do you think the Constitution is a magical, sentient, self-enforcing entity? If the people entrusted with enforcing the Constitution are unable or unwilling to do so, the Constitution is just a really old piece of paper.

Even the secret service will intervene, following the orders of the legitimate president over Trump.

The same could be said for the media, our politicians, our universities, etc. Every institution that people said would hold the line against this kind of autocratic takeover has opted to roll over and play dead instead.

Even if there is no election, the 25th amendment continues to operate, and there is still a valid line of succession. Trump’s and Vance’s terms end in January, 2029. Trump is out.

See above. If your statement were true, then we wouldn’t even have a President Trump because the 14th amendment would also have continued to operate and disqualify him from even running. But instead they just handwaved the 14th amendment away as unenforceable (read: Inconvenient). Someone has to actually invoke the 25th amendment, and Trump has purged anyone with the authority to do so.

Plus, the 25th amendment is intended for Presidents who are functionally unable to perform their duties. Coma patients. Severe stroke victims. Medical conditions. Stuff like that. And in case you don’t know, even if someone does try to invoke the 25th, all Trump has to do is basically show up and say “I am able to perform my duties” under his own power, and the invocation is automatically nullified.

Trump is a functional moron, and is terrible at the job, but he meets the minimum standards to remain in power under the 25th amendment. It’s not supposed to be an out against Presidents who do the job badly, it’s supposed to be a remedy for those who are physically unable to do the job at all. Trump does not meet that criteria.

Without an election, all House seats would be vacant, so there would be no Speaker. The line then goes to the President pro tempore of the Senate. Since only 1/3 of Senate terms expire in any election year, there is still a functioning Senate. It can select a “President pro tempore of the Senate”, who is 4th in line for the Presidency.

If there is an Electoral College, its votes cannot be certified by a non-existent House of Representatives, which means a president cannot be selected. However, the Senate certifies the EC votes for the Vice President, and/or selects the Vice President if the votes cannot be certified for some reason.

With either the senate-selected Vice President, or the senate-selected President pro tempore of the Senate, there will be a non-Trump president in the White House in January, 2029.

If we’re at a point where Trump suspends elections, none of this would apply any longer. Who remains in power would be dictated by who’s currently in power. Again, the Constitution is not a magical self-enforcing document. If the people in power are unwilling to enforce it, it becomes a really old piece of paper.

  • I like the term chaos facism to describe it, but the author is looking too deeply into things. Trump thinking the way the author believes would imply that Trump does things like think or plan.

Trump is only taking the advice Steve Bannon gave him, which is some pretty damn good advice if you’re looking to do an authoritarian takeover. Ignore laws. Do whatever you want and let the justice system try to keep up with you. Move so fast that the justice system, the media, and the people can’t keep up with it all so by the time they’re done even processing one thing, five more have made it completely under the radar. And on the chance that something does blow up in your face? Do something random, disruptive, and distracting that others have to deal with. Threaten to take over Tuvalu. Who cares why. Let everyone else be focused on figuring out what the hell you’re talking about and force them to spend time and resources dealing with that diplomatic disaster while you go back to whatever other things you actually care about. Did one of your cronies do something embarrasingly stupid? Just announce a 380% tax on coffee grounds or something. Not that you care about coffee. It’s just something to dangle out there in case the rubes start getting a little too uppity and need a distraction.

And that’s pretty much what Trump is doing. He does things so fast that the media and justice system can’t keep up with it all. Why do you think he’s pushing to eliminate nationwide injunctions? Because if one of his policies impacts a million people, he wants the justice system to have to deal with a million separate cases, not just one. And there’s only so much news that can be crammed on the front page of a website. Reporters can only push out so many Youtube clips.

    And it works well.

How many colleges have bent the knee to Trump? If you’re just saying Columbia, you’re wrong. Harvard and Yale have done the same thing. It just flew under the radar. And by the time you’re reading this, other colleges may have done the same.

How many law firms have bent the knee to Trump? Not just the two reported in the media, but how many others have flown under the radar?

How many times has Trump directly ignored or defied a court order without consequence?

How many people have been illegally deported from the US without due process?

And if you answer those questions, are you 100% confident in your answer? Or do you think your answer may be too low?

That’s chaos facism. Make it so nobody even knows what the fuck is going on from one minute to the next, let alone be able to do something about it.

  • I’m dumbfounded. Completely dumbfounded.

Trump is literally telling French companies operating in France that they have to comply with his Executive Orders.

French companies. In France. How fucking arrogant do you have to be?

Between insulting Denmark, threatening Greenland, and now trying to tell French companies how to conduct business, the entirety of Europe needs to start collectively standing up and telling Trump exactly how far he can go fuck off. Because he is not going to stop. If this goes unanswered, he will consider your ignorance as capitulation and therefore weakness and start making more batfuck stupid demands and act as if he genuinely believes he rules over your country.

Mark my words, Trump’s next step is ordering tariffs on something from France because of their DEI policies. I give it 7 days.

  • Because he has money. At that level, they apologize to you for the inconvenience and ask one of your representatives to come in and negotiate a possible surrender if you can fit it into your schedule.

You know the saying that if you owe the bank $1000 you have a problem, but if you owe the bank $100 million, they have a problem? Or how when you’ve got that much money, you’re not “crazy”, you’re just “eccentric”?

Same basic thing here. Musk didn’t commit a crime; it’s a “civil matter”. He’s not going to be arrested. He’ll just be “sued”. If the AG wants to try to butt heads with Trump and try to arrest Musk, the AG is going to be the one with the problem.

What, you didn’t think the law applied to them, did you?

  • Ok, so apparently you have no clue how the justice system works.

See, the first thing that they check is the size of your net worth. Musk gets the platinum tier. Which basically means he gets to do what he wants while his laywers hire lawyers who’s junior associates actually do the work. And despite them being a huge flight risk due to having private planes, boats, and all-but-unlimited resources at their disposal, they’re given the most lenient, unsupervised release conditions.

It’s also important to note that those on that level get the privilege of being able to ignore bail conditions, court orders, or other restrictions a minimum of ten times. And after that, the judge threatens to hold hearings asking him why they shouldn’t hold more hearings discussing the possibility of imposing monetary fines that are the equivalent of couch cushion change as a punishment. Members of the platinum tier aren’t subject to consequences that are typically reserved for lower tiers. At Gold, they can threaten you with it without actually imposing it. At platinum, they don’t even bother doing that.

And in the rare case that actual punishments are imposed on them, they get to remain free for a time to “get their affairs in order” and often also get to arrange the terms of their own incarceration, such as when they’ll surrender to custody, serving only on weekends or evenings, or even “house arrest” (legalspeak for “no punishment at all, but we’ll pretend it is”). They are often also allowed to remain free during the appeals process, which they have the opportunity to drag out indefinitely.

Few on the platinum tier even have to suffer the indignity of having to walk inside a courtroom, much less a jail cell.

I understand that you were looking at our court system from the point of view of one of us filthy commoners. I’m just here to clear up any misconceptions and make sure you understand that the US government considers people like Elon Musk and Donald Trump more equal than you and deserving of a justice system that caters towards giving them the little extras in life that they obviously deserve because they were born rich. If you don’t like being one of the poors, try being born rich next time.
